El cibercrimen como arma de guerra en el siglo XXI

Abstract

En este documento se tiene como objetivo general describir el estado actual del cibercrimen, específicamente las características y modalidades de cibercrimen actual, y los principales instrumentos de derecho internacional público expedidos por la ONU, UE y OTAN en la materia, que se desarrollarán comenzando por la evolución histórica del cibercrimen, en especial del ciberterrorismo, sus principales modalidades, impacto y costos de lo ciberataques, así como algunos de los diferentes instrumentos de derecho internacional público expedidos por los organismos multilaterales sobre la materia. Se espera dar respuesta al interrogante si ¿la regulación existente es suficiente o no para enfrentar los impactos del ciberterrorismo, o si por el contrario, se requiere mayor cooperación de la comunidad internacional para enfrentar este flagelo?, ante el creciente número de ataques cibernéticos. De la revisión documental se concluye que, a pesar de haberse expedido algunos instrumentos internacionales a nivel global como regional, y las estrategias generales de lucha contra el terrorismo, se requiere el fortalecimiento de la cooperación internacional, la asistencia mutua, el intercambio de información entre Estados y el acercamiento de la ciudadanía y grupos de interés a las TIC para enfrentar adecuadamente el ciberterrorismo.

The general objective of this document is to describe the current state of cybercrime, specifically the characteristics and modalities of current cybercrime, and the main instruments of public international law issued by the UN, EU and NATO on the matter, which will be developed starting with the historical evolution of cybercrime, especially cyberterrorism, its main modalities, impact and costs of cyberattacks, as well as some of the different instruments of public international law issued by multilateral organizations on the subject. It is expected to answer the question whether or not the existing regulation is sufficient to confront the impacts of cyberterrorism, or if, on the contrary, greater cooperation from the international community is required to confront this scourge, given the growing number of cyberattacks. From the documentary review, it is concluded that, despite having issued some international instruments at a global and regional level, and general strategies to combat terrorism, the strengthening of international cooperation, mutual assistance, and the exchange of information between states and the approach of citizens and interest groups to ICT to adequately confront cyberterrorist
